What To Do After A Motor Vehicle Accident

Protect yourself by taking some important steps after your accident:

1. Call 911 and gather your information as best as possible.

  • Call law enforcement from the scene immediately following the accident. Although you may not even feel that you have been injured, you should still be checked by a medical doctor after your accident.
  • Document the other driver’s information including, full name, license plate, driver’s license, and insurance information. Be sure to also document their contact information.
  • Document any witnesses, their names and contact information.
  • Alert your insurance company immediately.
  • Ask the officers at the scene when your accident report will be ready and be sure to get a copy of the report as soon as it becomes available. You may have to follow-up with law enforcement to ensure that they have prepared the report and that you can pick it up immediately.

2. Document as much as you can about the accident scene.

  • All of us carry our cell phones at all times, be sure to use your phone camera to record images and videos of the accident scene and surround areas. Do not leave anything out no matter how minor it may seem, you may need it later.

What you should not do following the accident:

  • Less is more; do not go into in-depth details with your insurance carrier beyond what is required, it is best to let your attorney speak with them on your behalf so as to protect you and not have any statement used against you in the future.
  • Do not give an assessment of your accident to your insurance company or the other driver’s insurance company as anything that you may deem harmless may infact be harmful to your case, again, let your attorney provide any necessary information and details on your behalf.
  • Outside of the police report, do not sign any documents whatsoever, either for your insurance company or the other drivers’ insurance company, let your attorney handle these matters for you so that they can protect you.
  • Do not accept any kind of settlement offer without the approval of your attorney whose job it is to get you the maximum compensation available under the law.

Fighting For Your Compensation

In the state of Georgia, you may be entitled to:

  • Medical expenses and lost wages
  • Compensation for pain and suffering
  • Claims for disability
  • Compensation for any decrease in your capacity to earn a wage.
  • Compensation for any property that was damaged.
  • Loss of services and companionship of a spouse (loss of consortium)

Building A Case For Negligence

A strong Personal Injury Claim is one that can prove that the neglicence of the other driver is the cause of your personal injuries, this includes proving that the other driver did one of the following:

  • Drove under the influence
  • Drove recklessly
  • Was Racing or Speeding
  • Was engaged in distracted driving
  • Was driving aggressively
  • Fell asleep at the wheel
  • Failed to obey any Georgia traffic laws
  • They experienced a malfunction or defect with their vehicle
  • Due to Hazardous road conditions, they lost control of their vehicle

The state of Georgia follows a Comparative Negligence law which means that if it is found that you were partly to blame for your accident, the compensation allowable can be reduced by whatever percent of fault they assign to you, therefore, if you are found to 10% responsible, you would only be able to collect 90% of the maximum allowable for damage.

Filing An Accident Claim

Filing an accident claim can be overwhelming an often, those rushing to get their claims out will make a mistake that can affect their injury claim later.  Southside Injury Law will construct your claim using all of the investigative material and reports that we have reviewed in order to give you the best claim possible.  You will never have to concern yourself with missing an item or filling it out incorrectly, Southside will take care of it for you.

Your claim will include some of the following:  detailed information about your injuries and damages, document the other drivers’  negligence and finally, the claim will include the request to compensate you for your damages.

Georgia is considered a “fault” state as it relates to auto accident insurance claims, so there are a variety of options when seeking compensation:

  • Filing a claim with your insurance carrier who will then pursue compensation from the other drivers’ insurance carrier.
  • Filing a claim through the at-fault drivers’ insurance carrier which is also known as a 3rd party claim or
  • Pursuing a personal injury suit through civil court which is the most common if negotiations for settlement do not work.

Southside Injury Law will initially contact the at-fault driver and their insurance carrier and/or attorney responsible for the auto accident. At any point, if a settlement cannot be reached, Southside will then begin to pursue the filing of a lawsuit on your behalf.

Southside Injury Laws’ always seeks to settle your personal injury case outside of court however, we have successfully litigated Personal Injury cases through the court throughout Georgia and will pursue the same means if necessary in your case as well. If the latter is necessary, either a judge or a jury may ultimately decide what compensation you will be entitled to under the law.

Insurance Company Negotiations

You should know that the at-fault drrivers insurance company may try to convince you to settle your claim, this often happens early on and in most cases, the offer is less than what you deserve under the law. Accepting their offer can mean that you will be unable to pursue further compensation in the future so it is advised that you speak with an attorney before continuing any form of settlement negotiations.

Let Southside Injury Laws’ experienced Personal Injury Attorneys negotiate on your behalf using strategic tools that assist our clients in pursuing the maximum compensation allowable–often resulting in a larger settlement than privately negotiating without counsel.
